President Trump’s legal challenges to the 2020 election are entering a new arena.
This is bad news for the Democrats.
And that’s because Amy Coney Barrett faced one demand about the election that has Joe Biden nervous.
Popular talk show host Mark Levin declared on his Fox News program that the Supreme Court must intervene in the 2020 election and stop Pennsylvania from certifying results showing Joe Biden carried the state.
Levin argued that Pennsylvania defrauded the public by illegally changing its rules on mail-in absentee voting.
“What we see here is fraud perpetrated against the people of Pennsylvania, against the American people and the Electoral College process by politicians who violated the constitution repeatedly, who have violated the rule of law by a rogue state Supreme Court,” Levin explained to his audience. “And unless the U.S. Supreme Court — as it did in Bush versus Gore — exercises legitimately its power of judicial review. We have a potential constitutional crisis in this matter. And in one way or another, Congress will have to resolve it on January 6. But the U.S. Supreme Court shouldn’t just sit there and take a pass when in fact it is time for the U.S. Supreme Court to intercede, which is exactly what the petitioners are asking it to do.”
Justice Samuel Alito reversed course and moved up the date for Pennsylvania to respond to a lawsuit by Congressman Mike Kelly arguing that the Pennsylvania legislature illegally changed the rules on absentee mail-in voting with a vote as opposed to the proper process to make such changes through a constitutional amendment.
Congressman Kelly sought to invalidate 2.5 million mail-in absentee ballots that were cast under this unconstitutional scheme.
Texas Senator Ted Cruz implored the Supreme Court to take up the case and announced that if the justices agreed to hear arguments on the matter then he would argue the matter personally.
“Petitioners’ legal team has asked me whether I would be willing to argue the case before #SCOTUS, if the Court grants certiorari. I have agreed, and told them that, if the Court takes the appeal, I will stand ready to present the oral argument,” Senator Cruz posted on social media.
With Amy Coney Barrett on the Supreme Court conservatives believe for the first time that they have a functioning five justice majority for the first time ever.
That led to some hope that the Supreme Court would step in and right what tens of millions of Trump supporters viewed as an obvious wrong.
At a rally in Georgia, President Trump said his campaign was waiting on a justice with the courage to do what is right.
Now the Trump legal team is hoping the Supreme Court will take up his case and give the President’s supporters their day to make their arguments.
