Democrats could always count on the left-wing judges to throw up obstacles to Donald Trump’s agenda.
Former Presidents Barack Obama and Bill Clinton stacked the judiciary with political cronies who were sure to put the Democrat Party agenda ahead of the Constitution.
But Barack Obama and Bill Clinton were left seeing red after what this court just ruled.
Democrats refuse to make any changes to immigration laws despite Customs and Border Patrol apprehending over 100,000 illegal aliens at the border in March and April.
President Trump has been trying to fix the crisis using his executive authority as is outlined under Article II of the Constitution.
But every time Trump has tried to tweak immigration or asylum laws, liberal activists have sprinted to the district courts within the Ninth Circuit Court of Appeals knowing its left-wing judges would grant nationwide injunctions to stop Trump’s immigration agenda.
So when President Trump announced a new plan that would require illegal aliens to wait in Mexico while their asylum cases were being adjudicated, Democrats confidently told themselves the policy had no chance of going into practice.
They predictably filed suit in California where an Obama appointed San Francisco judge initially blocked the policy.
But on appeal to the Ninth Circuit Court of Appeals, a three-judge panel – which included judges appointed by Barack Obama and Bill Clinton – ruled in President Trump’s favor and allowed the “remain in Mexico” policy to proceed.
Ronald Reagan appointed judge Diarmuid O’Scannlain wrote that, “DHS is likely to suffer irreparable harm absent a stay because the preliminary injunction takes off the table one of the few congressionally authorized measures available to process the approximately 2,000 migrants who are currently arriving at the nation’s southern border on a daily basis.”
The judges appointed by Barack Obama and Bill Clinton joined in allowing the policy to proceed, but raised their own questions about its constitutionality.
“The government is wrong,” Bill Clinton appointed Judge William Fletcher wrote. “Not just arguably wrong, but clearly and flagrantly wrong.“
Donald Trump praised the ruling on social media.
“Big Court win at our Southern Border! We are getting there – and Wall is being built!” the President wrote.
However, this is not the final victory.
The judges’ decision just allows the policy to proceed while the case is being decided.
But it is an important victory.
That’s because, in order for lawyers representing illegal aliens to win a temporary restraining order, they have to show they are likely to win on the merits.
In this case, three judges on the most liberal court in America came down on the side of believing that the Trump administration was ultimately likely to prevail on the merits.
Still, the “remain in Mexico” policy is not a silver bullet.
And it won’t cure the border crisis.
But ICE reports that in recent months, 87 percent of illegal alien families are not showing up for their court hearings after being released into the United States.
Anything to cut down on that number is a positive step in the right direction.
