Biden and his allies wasted no time in exploiting this tragedy for political gain.
White House press secretary Jen Psaki told reporters during a flight on Air Force One that Biden was considering imposing gun bans through executive fiat.
“We are considering a range of levers, including working through legislation, including executive actions to address, obviously, not just gun safety measures but violence in communities,” Psaki told the press.
Joe Biden pitched himself to voters as a moderate centrist that could “unite” the country.
But Psaki claimed that Joe Biden would bypass Congress to impose unconstitutional gun control via executive order.
“He is not going to allow for obstruction to get work done for the American people,” Psaki added. “But his preference and priority is working with members of both parties.”
During remarks at the White House, Biden declared that he would not wait one minute to act to ban guns and disarm American citizens.
“While we’re still waiting for more information, I don’t need to wait another minute, let alone an hour, to take common-sense steps that will save lives in the future, and to urge my colleagues in the House and Senate to act. We can ban assault weapons and high-capacity magazines in this country once again,” Biden exclaimed.
Democrats are not yet signaling their intention to blow up the filibuster to ram gun control through Congress.
And Democrats do not have 60 votes to break a filibuster so executive action may be the Democrats’ only chance to grab guns and attack the Second Amendment.
But Democrats and Joe Biden’s push to grab guns via executive order could run headlong into a conservative majority on the Supreme Court itching to take up another Second Amendment case.
The last significant Supreme Court case was the 2008 Heller case which for the first time defined the Second Amendment as a fundamental right.
But since, the Court has not touched issues such as magazine capacity limits, so-called “assault weapons” bans, red flag confiscation laws and gun licensing and registration.
The Supreme Court has been trying to get back into the Second Amendment arena to clarify some of these questions.
And Clarence Thomas—who is the longest-serving Supreme Court justice—would lead in any charge from the bench to strike down any unconstitutional gun control that Joe Biden tried to impose through illegal executive fiat.
