Joe Biden is about to pick one fight with Clarence Thomas that he will live to regret.
Democrats consider the ability to end the life of an unborn baby right up until the moment of birth – and in some cases after a baby is born alive – as the central tenant of their ideological catechism.
The entire American left reacted at DEFCON 1 level when the Supreme Court handed down a five to four decision that allowed a Texas law to go into effect that banned abortion after six weeks.
With Biden’s poll numbers slipping after the Afghanistan failure the administration hoped to rally the radical left base by announcing a lawsuit against Texas over the pro-life law.
“This kind of scheme to nullify the Constitution of the United States is one that all Americans, whatever their politics or party, should fear,” Attorney General Merrick Garland ranted.
Attorney General Garland explained that the law – which allows private citizens to file civil lawsuits of up to $10,000 over illegal abortions performed after six weeks – was somehow an “end run” around the Constitution.
“The obvious and expressly acknowledged intention of this statutory scheme is to prevent women from exercising their constitutional rights by thwarting judicial review for as long as possible,” Garland fumed.
And Garland gave away the game – that the left was worried more red states would pass similar pro-life laws and drastically cut down on the horror that is abortion.
Garland falsely claimed abortion was a constitutional right ignoring the fact that the Supreme Court wrongly decided Roe v. Wade by inventing a right to privacy that was never written into the Constitution.
“The further risk here is that other states will follow similar models with respect not only to this constitutional right but, theoretically, against any constitutional right,” Garland fumed.
Texas Governor Greg Abbott’s spokeswoman defended the law.
“Texas passed a law that ensures that the life of every child with a heartbeat will be spared from the ravages of abortion,” Governor Abbott’s spokeswoman explained. “We are confident that the courts will uphold and protect that right to life.”
Clarence Thomas waited 30 years for a case to overturn Roe v. Wade.
And it is highly likely that Thomas and the other conservative justices will dismiss Joe Biden’s lawsuit over a lack of standing, meaning the federal government can claim no legitimate injury and thus has no grounds to bring a lawsuit.
Thomas would likely want nothing more than to dismiss Biden’s nuisance lawsuit and continue taking steps to end the travesty that is Roe v. Wade.
