Democrats have a secret weapon to take down Donald Trump.
The left is counting on federal judges to perform their dirty work.
And this judge just smacked Donald Trump with a nasty surprise that he is going to hate.
Democrats stewed when Donald Trump declared a national emergency to unlock billions of dollars in military construction funds to build a wall along the Southern border.
Left-wing activists resorted to a familiar playbook as soon as the President made this announcement.
Liberal groups hunted around for a friendly Obama judge so they could file a lawsuit in a venue where the outcome was already determined.
And they found their man in U.S. District Court judge Haywood Gilliam, whom Barack Obama had appointed to the federal bench.
As expected, Gilliam issued a ruling permanently blocking border wall construction in Arizona, California, New Mexico, and Texas.
Gilliam wrote that the Trump administration’s argument “present[s] no new evidence or argument for why the court should depart from its prior decision, and it will not.”
“Because no new factual or legal arguments persuade the court that its analysis in the preliminary injunction order was wrong, [the groups’] likelihood of success on the merits has ripened into actual success,” Gilliam added.
The left-wing activists who filed the lawsuit cheered Gilliam’s ruling.
American Civil Liberties Union attorney Dror Ladin spiked the football and celebrated the victory.
“Congress was clear in denying funds for Trump’s xenophobic obsession with a wasteful, harmful wall,” Ladin’s statement read.
“This decision upholds the basic principle that the president has no power to spend taxpayer money without Congress’ approval.”
Sierra Club managing attorney Gloria Smith chimed in with a statement bragging about the decision.
“We’ve seen the damage that the ever-expanding border wall has inflicted on communities and the environment for decades. Walls divide neighborhoods, worsen dangerous flooding, destroy lands and wildlife, and waste resources that should instead be used on the infrastructure these communities truly need,” Smith’s statement exclaimed.
But Democrats and their allies in the activist left should not pop the champagne corks just yet.
The Trump administration is sure to appeal the ruling and there is a very good chance the case ends up before the Supreme Court.
If that happens, then all bets are off.
Given that the court already showed in the travel ban case that they are reluctant to second guess the President on matters of national security, many observers think the Trump administration will eventually emerge victorious in this court battle.
But that may not be the Democrats primary concern.
At this point, what they are most interested in is stalling for time.
Since the Supreme Court hears so few cases each term, liberals bet that if they can tie up the Trump administration in court, they can push settling these legal issues until after the 2020 election.
If Trump loses in 2020, the cases will go away as the incoming Democrat administration will simply change the government’s position and drop their appeals.
