Democrats are furious over Donald Trump’s latest court victory.
Despite the left’s absurd cries that Trump is a dictator, he’s fought battles through the courts and won.
One Supreme Court Justice complained about Trump’s victory and immediately regretted it.
The minute Donald Trump was inaugurated, the Democrats launched #TheResistance, an all-out assault on the Trump administration.
#TheResistance includes big media, the deep state, and activist judges all over the country.
The latest Trump administration rule that was blocked by a lower court was the “public charge” rule, which essentially denies green cards to immigration applicants who attempt to seek public assistance benefits.
It seems reasonable that welfare benefits should be limited to American citizens, but an activist judge ordered an injunction to block the rule.
This has been standard operating procedure from the left under Trump’s administration.
However, the Supreme Court ruled 5-4 in favor of the Trump administration in offering a stay on the lower court injunction, meaning the “public charge” rule can carry on while the appeals court fights the battle.
Justice Sotomayor wrote a scathing dissent and lashed out at the Trump administration in the process:
“[T]he Court’s recent behavior on stay applications has benefited one litigant over all others…It is hard to say what is more troubling, that the Government would seek this extraordinary relief seemingly as a matter of course, or that the Court would grant it.”
Sotomayor’s anger at the Trump administration is absurd.
This is the game of judicial gymnastics that the left has been playing for years.
They obstruct every move Trump makes even though they’re perfectly within his plenary powers outlined by the Constitution.
Senator Ted Cruz, a Harvard Law graduate and constitutional scholar, quickly fired back at Sotomayor’s claim.
“I read it a little bit like an arsonist complaining about the noise from the fire trucks,” Cruz quipped.
He’s exactly right.
This is the game the left wants to play.
Sotomayor is a devotee of the judicial realism school of thought, meaning she believes the Constitution is a living document that should be interpreted as judges see fit, as opposed to adhering to the text of the Constitution.
This leftist mindset is precisely what leads to judicial activism where judges block decisions they simply don’t like.
Cruz continued, “If you look to the facts of what’s happening with nationwide injunctions, I think it will explain why the Department of Justice has had to ask the Supreme Court to intervene over and over again.”
It’s been one legal battle after another because the injunctions from courts that have no real standing keep piling up.
Cruz said that these judges are “operating effectively as part of the resistance movement,” which is undeniably true.
If Sotomayor is tired of the emergency stays, perhaps she should be angered at the lower court judges who are jamming up the docket with frivolous injunctions.
Moments like this are exactly why it was so important for Republicans to rally behind Justice Brett Kavanaugh.
For too long, Democrats have used the judiciary to cram through what they couldn’t accomplish legislatively.
