The Supreme Court is shaping up to be a key 2020 battleground on many fronts.
But now the Justices were blindsided by a shocking decision.
And the Supreme Court got hit with this surprise announcement that could seal Donald Trump’s fate.
The Trump administration and Manhattan District Attorney Cyrus Vance, Jr. are locked in a legal fight over the DA’s demand that financial institutions comply with a subpoena to hand over Donald Trump’s tax returns.
District Attorney Vance wants to launch politically motivated local criminal investigations against a sitting President of the United States.
A lower court Democrat judge ruled in District Attorney Vance’s favor, but the President’s lawyers immediately appealed to the Second Circuit Court of Appeals.
After that appeal, President Trump’s lawyers and District Attorney Vance’s office reached a surprising agreement.
The President’s lawyers agreed that if they lose they will immediately petition the Supreme Court to hear the case in the current term and District Attorney Vance agreed not to enforce the subpoena until the Supreme Court weighed in.
Politico exclusively reported:
Trump’s lawyers agreed that if they lose a court battle scheduled for argument at the New York-based 2nd Circuit Court of Appeals on Wednesday, they will take no more than 10 days to petition the Supreme Court to hear the case.
Trump’s legal team also agreed that — if Trump appeals to the high court — he will ask the justices to hear the case in its current term. Typically, the last cases of the term are argued in April and the final decisions come by the end of June.
In exchange for Trump’s agreement to keep the legal fight moving at a brisk pace, lawyers from Manhattan District Attorney Cyrus Vance Jr.’s office agreed to hold off trying to enforce a grand jury subpoena issued to one of Trump’s accounting firms in August. The investigation relates to the Trump Organization’s role in alleged hush money payments to adult film star Stormy Daniels, as well as other matters.
The Supreme Court could decline to hear the case.
But given the fact that it involves a sitting President asking the court to decide major questions about separation of powers makes it highly likely the justices would take up the case.
If that comes to pass it would put the Supreme Court on track to hand down their decision at the end of June, which would toss this hand grenade into the Presidential contest just four months before Election Day.
If Democrats get their hands on Trump’s tax returns, at a minimum they will leak any embarrassing details such as the effective tax rate Trump paid after taking off his deductions allowed under the law.
At the worst, District Attorney Vance will immediately announce the President of the United States is under criminal investigation so that cloud hovers over Trump as voters head to the polls.
