Vice President Mike Pence is now on the hot seat.
Donald Trump and his supporters are counting on the Vice President to come through.
And this lawsuit will force Mike Pence to make the biggest decision of his life.
On January 6 Vice President Mike Pence will preside over a joint session of Congress where they will certify the Electoral College results.
Conservatives in the House plan to object to the results of six states on the account of massive voter fraud.
Trump supporters believe the Vice President can play a pivotal role in this event by deciding not to recognize pro-Joe Biden slates of electors due to fraud and instead acknowledge the Trump slate of electors as legitimate.
Texas Congressman Louie Gohmert filed a lawsuit in a Texas federal court asking a judge to strike down the 1887 Electoral Count Act which Gohmert and others claim unconstitutionally reduced the Vice President’s role in this event to ceremonial status by requiring the Vice President to do nothing more than announce the results of the Electoral College.

The lawsuit focuses on Pence’s role in an upcoming Jan. 6 meeting of Congress to count states’ electoral votes and finalize Biden’s victory over President Trump. Typically, the vice president’s role in presiding over the meeting is a largely ceremonial one governed by an 1887 federal law known as the Electoral Count Act.
But the Republican lawsuit, which was filed against Pence in his official capacity as vice president, asks a federal judge in Texas to strike down the law as unconstitutional. The GOP plaintiffs go further: They ask the court to grant Pence the authority on Jan. 6 to effectively overturn Trump’s defeat in key battleground states.
To be sure, this is an extreme long shot.
Some Trump supporters will view it as a betrayal if Pence merely affirms the results of what they see as a fraudulent election.
That could have dire consequences for Vice President Pence’s political future.
If Donald Trump is not President on January 20, 2021 and he decides not to run for re-election in 2024 then Mike Pence will be expected to start out as one of the top contenders in the Republican nominating contest.
Some Trump supporters may not vote for Pence because they will not believe he did everything in his power to stop Democrats from stealing the 2020 election.
Donald Trump rescued Mike Pence from an uncertain political future in 2016 when Trump selected Pence as his running mate.
And a large segment of the GOP base will believe Pence should repay that gesture by pulling out all the stops to not legitimize a stolen election.
