The 2020 Presidential Election could very well be decided by the Supreme Court.
It is shaping up to be one of the biggest battlegrounds between the two parties.
And now Donald Trump is about to ask the Supreme Court to do this one thing that no one saw coming.
Donald Trump won the last election in large part because of his promise to appoint conservative justices to every level of the federal bench.
The importance of that promise came into focus as the left deployed forum shopping to find friendly Obama judges to strike down Trump agenda items.
That happened once again in a District Court in New York where U.S. District Judge Paul Engelmayer handed down a 147 page rant striking down the Trump administration’s conscience rule.
Engelmayer – an Obama appointed activist – offered up the outrageous argument that “the Court has found that HHS’s stated justification for undertaking rulemaking in the first place—a purported ‘significant increase’ in civilian complaints relating to the conscience provisions—was factually untrue.”
Judge Engelmayer also ranted that threatening to withhold federal funding from facilities that forced medical practitioners to perform abortions against their deeply held religious beliefs was “wherever the outermost line where persuasion gives way to coercion lies, the threat to pull all HHS funding here crosses it.”
New York State Attorney General Letitia James gloated about the decision.
“The refusal of care rule was an unlawful attempt to allow health care providers to openly discriminate and refuse to provide necessary health care to patients based on providers’ ‘religious beliefs or moral objections,’” James bragged.
The abortion lobby also praised the ruling.
“We are heartened by today’s ruling, and we will not stop fighting to prioritize patients’ need for standard medical care over health-care personnels’ personal religious or moral beliefs,” the National Family Planning and Reproductive Health Association declared.
The Trump administration will surely appeal this ruling all the way to the Supreme Court.
But it is an open question if the court will take on the case in an election year.
The Justices already agreed to tackle the abortion issue by agreeing to hear a case concerning a Louisiana law requiring doctors that perform abortions to have emergency room admitting privileges.
Would the Supreme Court agree to hear a second case centered on abortion in the months before a Presidential Election?
That is not certain.
However, what is certain is Donald Trump’s fighting for the issue of life – even if he loses in court – could prove to be a powerful motivator for Evangelical voters.
Some voters that may be leery of Trump’s conduct or language would be willing to set aside those concerns to support a President that appointed a record number of federal judges.
If the President has four more years to stock the bench with conservative justices, Donald Trump chokes off the ability of the left to “forum shop” for friendly leftist activists that issue rulings completely detached from the law or the Constitution, but serve the purpose of thwarting a conservative policy agenda.
