This was the decision Trump supporters were waiting for.
Democrats are going to hate it.
And all hell broke loose when the courts crushed Joe Biden in this major case.
The Fifth Circuit Court of Appeals took a stand for freedom and individual liberty by remanding a challenge to the United Airlines vaccine mandate back to District Court Judge Michael Pittman.
Pittman originally ruled against the employees challenging the mandate.
But Justices Andy Oldham and Jennifer Elrod overruled Pittman.
“Plaintiffs allege a harm that is ongoing and cannot be remedied later: they are actively being coerced to violate their religious convictions. Because that harm is irreparable, we reverse the district court,” the majority ruled.
In the earlier decision, Judge Pittman expressed his sympathy with the plight of the United Airlines pilots, but that the law tied his hands.
“The Court is not insensitive to Plaintiffs’ plight. A loss of income, even temporary, can quickly ripple out to touch nearly every aspect of peoples’ lives, and the lives of their families and dependents. But the Court’s analysis must be guided by the law, not by its sympathy,” Judge Pittman wrote.
But Justices Oldham and Elrod found that the vaccine mandate did cause an irreparable harm.
Judge Pittman found it did not because anyone who was put on indefinite leave over the vaccine mandate could just get backpay.
But Justices Oldham and Elrod found that was not the only form of irreparable harm.
They wrote that if United forced a pilot to violate their religious beliefs to take the vaccine that could not be undone.
“The first is United’s decision to place them on indefinite unpaid leave; that harm, and any harm that flows from it, can be remedied through backpay, reinstatement, or otherwise,” the judges ruled. “The second form of harm flows from United’s decision to coerce the plaintiffs into violating their religious convictions; that harm and that harm alone is irreparable and supports a preliminary injunction.”
As polling shows swing voters are ready to punish Democrats over imposing mask mandates, lockdowns and vaccine passports, Joe Biden still stands by COVID mitigation measures.
Biden still wears a mask – even when he is outside and by himself – and absolutely supports vaccine mandates.
Courts rejected Biden’s illegal and tyrannical vaccine mandate for private sector employers with more than 100 workers.
But so far, the court stood by companies imposing vaccine mandates on their workers.
This was the last bastion of the COVID regime yet to fall.
But a majority of the Fifth Circuit Court of Appeals ruling against the United Airlines vaccine mandate could be a sign that courts are ready to step in and say enough is enough.
