Chuck Schumer and the Democrats are running out of options.
Once Donald Trump names his successor to Ruth Bader Ginsburg, the clock is ticking on their eventual defeat.
And now Chuck Schumer just waved the white flag in this fight to fill Ginsburg’s seat.
As soon as it became clear Donald Trump would nominate a successor to the late Ruth Bader Ginsburg and Senate Republicans would push forward with a confirmation vote, Democrats began a campaign of intimidation to try and frighten Republicans out of moving forward.
Alexandria Ocasio-Cortez and other Democrats threatened that if they won power in November, then impeachment, packing the courts and eliminating the legislative filibuster were on the table.
Chuck Schumer told Senate Democrats in a conference call that “everything is on the table. My Senate democratic colleagues and candidates know America needs some change. And we are going to figure out the best way to do it.”
But as the days went on, a sense of reality set in with the Democrat Party as it became clear just how unpopular those positions were.
NBC News exclusively reported, “Many of those Democrats worry that vowing to permanently alter the upper chamber and threaten the structure of the court — by eliminating the filibuster or adding Supreme Court seats — could complicate the party’s chances in swing states where Democrats are attempting to beat Republican incumbents.”
In a local TV interview, Joe Biden went so far as to refuse to answer if he would support packing the courts in response to Senate Republicans confirming Ginsburg’s successor.
Michigan Senator Gary Peters is in a tight re-election fight against Republican John James and Peters dismissed the idea of court-packing.
“We’ve got to focus right now on COVID,” Peters stated. “I’m really frustrated by all this talk about moving this forward when Mitch McConnell who refuses to deal with the crisis that I’m hearing about back home. All this other stuff is parlor games. Let’s focus on what’s happening in our states.”
Other Senate Democrats from swing states also shot down the idea of packing the court as a measure of revenge.
“Despite calls from the left to add seats to the court, a number of Senate Dems are not in favor of that – including Doug Jones, Joe Manchin and Jeanne Shaheen. ‘No,’ Shaheen told me yesterday when asked if she backs that idea. Dem leaders are staying mum,’” fake news CNN’s Manu Raju reported.
President Roosevelt tried to pack the court at the peak of his popularity in the 1930s and the backlash from the American people was so severe that even Roosevelt – who went on to win two more presidential elections – backed down.
Chuck Schumer is now learning this lesson as his party backs away from the ledge on this fight.
