The Supreme Court is the one power center in America that Democrats do not control.
Democrats found out just how much they had to worry about.
And Clarence Thomas handed down one ruling that left Joe Biden sweating bullets.
In Joe Biden’s Washington, Democrats have their sights set on gutting the First Amendment as well as religious liberty.
But the Supreme Court threw down a marker that the majority of justices on the Court will not look kindly on the left’s secular censorship routine.
Clarence Thomas wrote an important 8-1 majority opinion in the case of Uzuegbunam v. Preczewski.
Chike Uzuegbunam was an evangelical Christian student at Gwinnett College in Georgia.
The college restricted Uzuegbunam to preaching his Christian faith in two approved “free speech zones” on campus that made up .0015 percent of the campus and a student wishing to access the “free speech zones” also needed to obtain a permit from the school.
On the day Uzuegbunam obtained a permit to speak, two police officers demanded he stop, citing complaints from other students and the “free speech zone” prohibiting anything that “disturbs the peace and/or comfort of person(s).”
Uzuegbunam sued but the school motioned to dismiss the case as moot because they rescinded the policies in question and because Uzuegbunam was only seeking nominal damages of one dollar.
Clarence Thomas shot down these arguments.
In a case last year, New York City repealed a law about prohibiting gun owners from travel with their lawful firearms in their cars.
Democrats in New York knew they would lose and raced to make the case moot.
Thomas argued that nominal damages were a way to redress an injury and ended the practice of Democrats trying to play games with the law to avoid damaging Supreme Court precedents that would forever strike down their unconstitutional power grabs.
In addition, Thomas went even further and declared that Gwinnett College violated Uzuegbunam’s constitutional right to free speech and religious liberty.
“Applying this principle here is straightforward. For purposes of this appeal, it is undisputed that Uzuegbunam experienced a completed violation of his constitutional rights when respondents enforced their speech policies against him. Because ‘every violation [of a right] imports damage’…nominal damages can redress Uzuegbunam’s injury even if he cannot or chooses not to quantify that harm in economic terms,” Thomas wrote.
This is a warning shot to Democrats and the Biden administration.
Censorship is at the top of the Democrat Party’s agenda now that Joe Biden, Nancy Pelosi and Chuck Schumer control the White House and Congress.
Democrats want legislation regulating so-called “hate speech” on social media platforms.
In reality, hate speech—like “disinformation”—is really just speech Democrats disagree with.
And one of the organizing principles of the modern Democrat Party is the idea that no one to the right of The New York Times’ editorial page should be allowed to speak their political views in public.
Clarence Thomas fired a clear shot across the bow of pro-censorship Democrats that the Supreme Court would take a strong stand in favor of free speech.
