No president’s ever had a worse week than Joe Biden.
It was one series of defeats after another.
And the cherry on top came when Clarence Thomas just ruined Joe Biden’s week with this devastating court defeat.
Joe Biden suffered a disastrous series of defeats.
Two key Senate Democrats – West Virginia’s Joe Manchin and Arizona’s Kyrsten Sinema – drove a dagger through the heart of Biden’s push to rig elections in the Democrats’ favor by announcing their opposition to nuking the legislative filibuster.
A Quinnipiac poll showed Biden’s approval rating sinking to 33 percent.
Biden’s promise to shut down the virus collapsed as the Omicron variant ran wild.
And to top it all off the Supreme Court smacked down Joe Biden’s federal vaccine mandate for companies with more than 100 workers.
The court’s six Republicans – led by Clarence Thomas – rejected the Biden administration’s un-American and illegal power grab to mandate vaccinations at the workplace.
In the unsigned majority opinion, the six Republican-appointed justices blasted the Biden administration for an unprecedented federal power grab.
“Administrative agencies are creatures of statute. They accordingly possess only the authority that Congress has provided. The Secretary has ordered 84 million Americans to either obtain a COVID–19 vaccine or undergo weekly medical testing at their own expense. This is no ‘everyday exercise of federal power,’” the opinion read.
The justices explained it was not their job to weigh on the cost-benefit analysis of public health policy.
“We are told by the States and the employers that OSHA’s mandate will force them to incur billions of dollars in unrecoverable compliance costs and will cause hundreds of thousands of employees to leave their jobs,” the justices continued. “For its part, the Federal Government says that the mandate will save over 6,500 lives and prevent hundreds of thousands of hospitalizations. It is not our role to weigh such tradeoffs.”
Instead, the justices stated their only job was to interpret the law as written.
And in this case, the law was simple.
If Congress wanted the Occupational Safety and Health Administration to impose a federal vaccine mandate it would have passed a law saying so.
But since Congress never used its Article One authority to write legislation granting OSHA the ability to authorize vaccine mandates, Joe Biden’s illegal, tyrannical and unconstitutional vaccine mandate did not pass legal muster.
“Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly. Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category,” the justices ruled.
