Democrats are exploiting the coronavirus pandemic to settle the score with all their enemies.
Not only does the left think they can drive Donald Trump from office, but they want to silence all of his supporters once and for all.
And now Fox News Channel just got smacked with some bad news about a lawsuit that could force it off the air.
The radical left-wing activist group Washington League for Increased Transparency and Ethics (WASHLITE) sued Fox News in Washington state, alleging Fox News violated consumer protection laws through “deceptive” coverage of the coronavirus.
WASHLITE claimed Fox News hosts like Sean Hannity put lives in danger by supposedly downplaying the threat of the coronavirus.
Washington state Judge Brian McDonald heard arguments on if the lawsuit should be allowed to proceed and appeared to express sympathy for the left-wing activists trying to take Fox News off the air.
Judge McDonald asked why someone can sue for damages to their reputation but not public health.
“As a policy rationale, it would seem an individual’s reputation is less valuable to society as a whole than making sure accurate information gets out about a life-threatening disease,” McDonald said.
Fox News’ lawyers responded by stating that the First Amendment permitted free speech and America would tread into dangerous grounds if courts deemed themselves the sole arbiters of what constituted the only and allowable truth that could be broadcast on television, published in a newspaper or posted online.
Bloomberg Law exclusively reported that, “Michael Carvin, a lawyer for Fox, said that under the First Amendment, the best way to expose falsehoods is to allow all statements to flourish so that the truth emerges. He also said the idea that there is ‘infallible truth’ about the virus is illusory and noted that the guidance from the Centers for Disease Control and Prevention changes all the time.”
WASHLITE’s lawyer, Catherine Clark, countered that lying is not constitutionally protected speech.
“There has never been a right to lie,” Clark argued to Judge McDonald. “There has never been a right to make a patent false statement, particularly on something like a pandemic.”
Even Fox News Channel’s left-wing rivals MSNBC and fake news CNN realized the danger to the First Amendment this lawsuit posed.
The NCTA – which includes the parent companies of MSNBC and CNN – as well as the Reporters Committee for Freedom of the Press, filed an amicus brief supporting Fox News Channel’s motion to dismiss the lawsuit.
“While all cable programming enjoys First Amendment protection, the constitutional prohibition against unwarranted governmental interference with programming on news networks is especially clear,” the amicus brief read.
Democrats simply do not believe in the First Amendment.
The coronavirus pandemic made this clear.
Democrat governors kept churches closed, violating the free exercise clause, and now liberal activists want to seize the moment to shut down Fox News.
