Fox News has been public enemy number one in the eyes of many on the left for nearly two decades.
Now liberal activists think they stumbled upon the silver bullet to bring down the Fox News juggernaut.
And now Fox News is facing this lawsuit that could shut the network down for good.
Fox News won a legal victory when a district court judge dismissed a lawsuit by the family of slain Democrat National Committee staffer Seth Rich over a 2017 story by reporter Malia Zimmerman which was sourced to a private investigator hired by Texas financier Ed Butowsky that alleged Rich was the source of the hacked Democrat National Committee emails that WikiLeaks released in the summer of 2016.
A three judge panel on the Second Circuit Court of Appeals unanimously overturned the District Court judge’s decision and allowed the Rich family’s lawsuit to proceed.
“The allegations — which we have to take as true — are that Zimmerman and Butowsky (i) intentionally planted a biased investigator to gain the trust of a grieving family; (ii) fed false information to the investigator with the sole purpose of exploiting that investigator’s relationship with the family to give credence to a politically motivated story; and (iii) knew, from the very start, that this story was nothing more than a false conspiracy theory,” Judge Guido Calabresi held. “All that is more than enough to counter any possible justification.”
Fox News responded to the setback in a statement.
“The court’s ruling today permits Mr. and Mrs. Rich to proceed with discovery to determine whether there is a factual basis for their claims against Fox News,” Fox News’s statement declared. “And while we extend the Rich family our deepest condolences for their loss, we believe that discovery will demonstrate that Fox News did not engage in conduct that will support the Riches’ claims. We will be evaluating our next legal steps.”
WikiLeaks founder Julian Assange hinted that someone inside the Democrat National Committee – and not Russian government aligned hackers – was the source for the emails WikiLeaks published in the summer of 2016.
Police believe Rich was killed in a failed robbery gone bad.
But no suspects have been arrested or charged which led many Americans to wonder if Rich was WikiLeaks’ inside man on the email leaks.
This lawsuit has been a major focus of fake news CNN’s media team.
Fake news reporters Brian Stelter and Oliver Darcy accused Fox News of peddling in a conspiracy theory and liberal activists joined CNN in trying to pressure advertisers to drop Sean Hannity’s program over Hannity’s coverage of this story in an effort to force Hannity off the air.
CNN and other anti-Fox liberals are no doubt rooting for the Rich family to win a massive monetary award in this lawsuit to fully discredit Fox News and either knock them off their perch as the top rated network in cable news, or to force Fox to become another fake news liberal media outlet like CNN or MSNBC.
