Joe Biden experienced another massive stumble in his error-filled Presidency.
Biden’s rush to undo Donald Trump’s legacy just backfired.
That’s because Joe Biden suffered a big defeat in court that left Trump grinning from ear to ear.
Joe Biden made sure to rubberstamp whatever open borders policy item the radicals in his administration put in front of him.
That included one executive order to pause nearly all deportations for 100 days in a move that will allow wife-beaters, drunk drivers and illegal aliens that kill people in car accidents to remain in the country.
Illegal aliens understood what was going on.
CNN interviewed one member of the migrant caravan who declared that Joe Biden gave them 100 days to earn their free pass into America.
Led by Attorney General Ken Paxton, the state of Texas sued the Biden administration to stop this dangerous open borders order.
U.S. District Judge Drew B. Tipton issued a ruling blocking the order nationwide for 14 days while both sides prepared arguments for a temporary injunction.
Tipton cited the cost incurred by the state of Texas by not deporting illegal aliens.
“First, Texas demonstrates that it pays millions of dollars annually to provide social services and uncompensated healthcare expenses and other state-provided benefits to illegal aliens such as the Emergency Medicaid program, the Family Violence Program, and the Texas Children’s Health Insurance Program,” Tipton began.
“Additionally, Texas has presented evidence that it would incur increased educational costs … Texas anticipates suffering financial harm from which it cannot recover by suing the federal government,” Tipton added.
Attorney General Paxton celebrated Texas’ victory over the Biden administration.
“VICTORY. Texas is the FIRST state in the nation to bring a lawsuit against the Biden Admin. AND WE WON. Within 6 days of Biden’s inauguration, Texas has HALTED his illegal deportation freeze. *This* was a seditious left-wing insurrection. And my team and I stopped it,” Attorney General Paxton tweeted.
This ruling showed the lawfare the left waged against the Trump administration could be turned around to frustrate the Biden agenda.
During Trump’s four years in office, Democrats would often find a friendly District Court judge in Hawaii or San Francisco to issue a nationwide injunction blocking Trump initiatives.
Trump would eventually win at the Supreme Court, but it would gum up the gears of the administration’s policy agenda for months.
Judge Tipton also used the mechanism Chief Justice John Roberts deployed to block the Trump administration from including a question about citizenship on the census.
In the ruling, Judge Tipton leaned on the Administrative Procedure Act to rule that Biden did not properly explain why deportations needed to be paused for 100 days other than it was merely a symbolic number.
Red state attorney generals are determined to show two can play at that game.
But the only difference is the six to three conservative majority on the Supreme Court will likely not look kindly on the unconstitutional power grabs Biden is trying to impose through executive fiat.
