Donald Trump just got hit with some really bad news.
And it came from one of the most surprising sources.
That’s because Neil Gorsuch just made one ruling that could cost Trump everything in 2020.
In a shocking six to three decision, the Supreme Court rewrote the 1964 Civil Rights Act to grant special rights to homosexuals and transgenders making it illegal for churches, religious institutions and any other employer in America to fire a homosexual or transgender employee.
But what stung even more for conservatives was the fact that Neil Gorsuch – Donald Trump’s first Supreme Court nominee – authored the tortured and poorly reasoned opinion.
Gorsuch claimed the Civil Rights Act made sexual orientation and gender identity a protected class even though those words are never mentioned in the legislation.
“But the limits of the drafters’ imagination supply no reason to ignore the law’s demands. When the express terms of a statute give us one answer and extratextual considerations suggest another, it’s no contest. Only the written word is the law, and all persons are entitled to its benefit,” Gorsuch began.
“An employer who fires an individual for being homosexual or transgender fires that person for traits or actions it would not have questioned in members of a different sex. Sex plays a necessary and undistinguishable role in the decision, exactly what Title VII forbids,” Gorsuch added.
Chief Justice John Roberts also joined Gorsuch and the court’s four liberals in the decision.
But Roberts has voted with the left so often that conservatives consider the Chief Justice a lost cause and essentially an establishment liberal.
The court’s three other conservatives – Clarence Thomas, Brett Kavanaugh and Samuel Alito – sided with the Constitution and opposed this travesty of a decision.
In a strongly worded dissent authored by Justice Alito and signed by Thomas and Kavanaugh, Alito shredded the decision as “preposterous.”
“The Court tries to convince readers that it is merely enforcing the terms of the statute, but that is preposterous. Even as understood today, the concept of discrimination because of ‘sex’ is different from discrimination because of ‘sexual orientation’ or ‘gender identity,’” Alito wrote.
Alito then went on to attack the majority by saying there was a word for what it did and that was called “legislate.”
If Congress wanted to protect homosexuals and transgenders under the Civil Rights Act, it is free to change the law.
Democrats repeatedly tried to pass the “Gay Bill of Special Rights” but it failed to acquire the necessary votes for passage because Republicans objected to its attacks on religious liberty.
Justice Gorsuch imposed by judicial fiat legislative language the Democrats failed to pass through Congress.
This could have massive ramifications for Donald Trump’s re-election campaign.
The President planned on making his appointments of Neil Gorsuch and Brett Kavanaugh to the Supreme Court the cornerstone of his appeal to the conservative base.
Now some conservatives view Gorsuch as another conservative that grew into being a liberal the longer they served on the court.
And it is now an open question if the President can campaign on the Supreme Court to motivate conservatives to turn out in November.
