Donald Trump intended to head into the General Election touting his nomination of conservative judges like Neil Gorsuch to the bench as a reason Americans should give him a second term.
But now all hell is breaking loose.
Now Neil Gorsuch made Donald Trump regret nominating him after this stunning betrayal.
Supreme Court Justice Neil Gorsuch already gave conservatives heartburn with a decision imposing special rights for homosexuals and transgenders.
To make matters worse, Gorsuch doubled down on that decision by granting half of Oklahoma to the Muscogee Nation Indian tribe in order to let a convicted felon that raped a four-year-old child out of jail.
“Today we are asked whether the land these treaties promised remains an Indian reservation for purposes of federal criminal law. Because Congress has not said otherwise, we hold the government to its word,”Gorsuch wrote in his majority opinion.
Gorsuch argued that the Major Crimes Act — which gave federal authorities jurisdiction over crimes committed by or against members of Native American tribes on tribal lands — reigned supreme in this case and invalidate the state of Oklahoma’s conviction against Jimcy McGirt, a Muscogee Nation member.
“For MCA purposes, land reserved for the Creek Nation since the 19th century remains ‘Indian country,’” Gorsuch added.
In a surprising development, liberal Chief Justice John Roberts sided with the court’s three other conservative justices and authored the dissent.
Roberts argued that granting the Muscogee tribe dominion over half of Oklahoma would mean hundreds of convictions risked being thrown out.
“On top of that, the Court has profoundly destabilized the governance of eastern Oklahoma,” Chief Justice Roberts argued. “The decision today creates significant uncertainty for the State’s continuing authority over any area that touches Indian affairs, ranging from zoning and taxation to family and environmental law.”
Roberts also argued that Congress undid whatever promise was made by Andrew Jackson through a series of legislative steps when it granted Oklahoma statehood.
“None of this is warranted,” Robertscontinued. “What has gone unquestioned for a century remains true today: A huge portion of Oklahoma is not a Creek Indian reservation. Congress disestablished any reservation in a series of statutes leading up to Oklahoma statehood at the turn of the 19th century. The Court reaches the opposite conclusion only by disregarding the ‘well settled’ approach required by our precedents.”
When Donald Trump set about to pick a nominee to replace Antonin Scalia, the conservative legal establishment sold him on the fact that Gorsuch was a rock-solid conservative.
That turned out not to be the case.
And the conservative legal establishment’s betrayal of Donald Trump now endangers his re-election prospects.
