Ruth Bader Ginsburg made this big decision that left Donald Trump blindsided.
Donald Trump and many of his supporters had all but given up on the Supreme Court.
In two recent decisions,Chief Justice John Roberts and Neil Gorsuch stabbed conservatives in the back to grant homosexuals and transgenders special rights and stop the Trump administration from ending Barack Obama’s lawless amnesty program.
But in a shocking seven to two decision, the court delivered President Trump a resounding victory over open borders advocates by allowing the administration to proceed with “expedited removal” of fraudulent asylum seekers that failed their initial screening.
Left-wing Supreme Court Justice Ruth Bader Ginsburg joined the majority in handing President Trump this crucial victory.
Conservative Justice Samuel Alito authored the majority opinion.
“Simply releasing him would not provide the right to stay in the country that his petition ultimately seeks. Without a change in status, he would remain subject to arrest, detention, and removal,” Alito’s opinion read. “The Government is happy to release him — provided the release occurs in the cabin of a plane bound for Sri Lanka …The relief requested falls outside the scope of the writ as it was understood when the Constitution was adopted.”
Alito argued that ending expedited removal would crush the immigration system with a backlog of cases as illegal aliens appeal their asylum rejection.
“The past decade has seen a 1,883% increase in credible-fear claims,” Alito wrote. “If courts must review credible-fear claims that in the eyes of immigration officials and an immigration judge do not meet the low bar for such claims, expedited removal would augment the burdens on that system.”
Left-wing Justice and open borders radical Sonia Sotomayor authored the dissent arguing that.
“Today’s decision handcuffs the Judiciary’s ability to perform its constitutional duty to safeguard individual liberty and dismantles a critical component of the separation of powers,” Sotomayor wrote, joined by Kagan. “It will leave significant exercises of executive discretion unchecked in the very circumstance where the writ’s protections ‘have been strongest,’ And it increases the risk of erroneous immigration decisions that contravene governing statutes and treaties.”
President Trump and his supporters breathed a sigh of relief and exclaimed that it was about time they came out on the winning end of a major Supreme Court case.
Even though Donald Trump appointed Brett Kavanaugh and Neil Gorsuch to the Supreme Court, the court drifted left thanks to Chief Justice John Roberts turning into a reliable liberal vote in major cases.
That’s why so many conservatives were surprised to see that not only did the Trump administration win this case, but that left-wing Supreme Court Justice Ruth Bader Ginsburg joined the majority in President Trump’s favor.
