Nancy Pelosi and the Democrats are pulling a power play ahead of 2020.
But that scheme backfired big time.
And Ted Cruz just shut down Nancy Pelosi with this one truth bomb.
Nancy Pelosi is withholding articles of impeachment to try and blackmail Republicans into turning over control of a Senate trial to Democrats.
Democrats rushed through impeachment in the House rather than letting court cases play out over President Trump’s claim of executive privilege which blocked John Bolton and Mick Mulvaney from testifying.
Pelosi wants the Senate to conduct the fact-finding investigation that Democrats in the House were unwilling to pursue.
However that strategy has one major downside.
In an interview on Fox News Channel’s “Sunday Morning Futures,” Texas Senator Ted Cruz pointed out that if the Democrats call witnesses then due process and fairness would dictate that the President be able to call his own witnesses.
And Cruz explained the President’s witness list could pose major problems for Pelosi and the Democrats.
“If the president wants to call Hunter Biden, if the president wants to call the whistleblower, due process mandates we allow the president to present his case. We should do so. That is the question for the president and legal team,” Cruz stated.
Republicans are proposing to operate the Trump impeachment trial under the same rules as the Clinton trial back in 1999.
Back then, Republicans and Democrats agreed 100 to 0 on a format of opening statements by both sides followed by written questions submitted by Senators and then witness testimony if a majority agreed that was necessary.
In that trial, three witnesses ended up giving closed door testimony before the Senate acquitted Bill Clinton on the House of Representatives’ articles of impeachment.
Currently no Republicans have specifically demanded witness testimony.
Democrats need four Republicans to break ranks and lock arms with them in order to give Chuck Schumer control over a Senate impeachment and witness trial.
Right now, Democrats know that is an uphill fight.
Chuck Schumer and Nancy Pelosi also know that their only leverage is before a trial starts.
Once the trial gets underway, the Democrat House impeachment managers will put on their case and the President’s lawyers will present their defense.
At that point both sides will spend two weeks rehashing old ground and previous testimony and evidence.
Democrats will face a tough road convincing Republicans that they need to expand the trial and waste more time on witness testimony.
Nancy Pelosi understands the outcome of this impeachment farce will not go the Democrats’ way.
And the Speaker delaying turning over the articles of impeachment is seen by many political experts as nothing more than trying to string this process along to muddy the waters and to try to deny the President the right to claim 100 percent exoneration once a bipartisan Senate majority acquits Donald Trump.
