That’s because the Supreme Court is about to get this major election overhaul.
Court-packing is an idea that Democrats have been considering for a long time.
Franklin Roosevelt had a plan that would allow him to get up to 15 Supreme Court justices on the bench after the court limited his expansion of the power of the federal government.
This failed since congressional Democrats were unwilling to back FDR’s plan.
Democrats are again trying to expand the powers of the federal government and know that they might run into trouble with the Supreme Court.
While the Supreme Court is not consistently conservative, the Democrats can’t pass whatever legislation they want any more either.
That’s why the Democrats are looking to go back to court-packing and removing the judges that Trump appointed.
The way the Democrats describe these plans is as a pledge “to increase transparency and accountability” which the DNC is considering adding to their platform.
FDR was smart enough to only try his court-packing plan after he won reelection.
But the DNC may put it on the Democrats’ platform to support “structural court reforms to increase transparency and accountability,” according to NBC News.
The Democrats also would likely condemn Republicans for packing “our federal courts with unqualified, partisan judges who consistently rule for corporations, the wealthy, and Republican interests” and “blocking a Democratic president from appointing a justice to the Supreme Court” in the amendment the DNC is considering.
Democratic Sen. Mazie Hirono of Hawaii has many ideas on how she could fix these perceived problems. She’s been “talking with people who have different ideas about what we can do — including adding to the court, including having certain circuit court judges cycle in and other ideas.”
Democrats are terrified that Donald Trump will get the chance to appoint another Supreme Court judge before the election.
Supreme Court Justice Ruth Bader Ginsburg recently accounted that she is fighting cancer again, after hiding the diagnosis for four months.
Senate Judiciary Committee Chairman Lindsey Graham has indicated that if a seat opens up on the Supreme Court, Republicans would try to fill it even though they blocked Obama’s nominee, Merrick Garland, in 2016.
“Merrick Garland was a different situation,” Graham said. “You had the president of one party nominating, and you had the Senate in the hands of the other party. A situation where you’ve got them both would be different. I don’t want to speculate, but I think appointing judges is a high priority for me in 2020,” Graham said in May.
Republicans had to put up with a hostile Supreme Court for years. Now that Democrats are in the same position, they’re trying to change the rules.
