Donald Trump’s path to acquittal in a Senate trial just hit an unexpected road block.
Democrats in Congress cheered a development that indicated they may gain an unexpected ally in any Senate proceeding.
And that’s because the Supreme Court smacked Donald Trump with this massive impeachment betrayal.
Supreme Court Justice John Roberts is no friend to conservatives.
Roberts famously stabbed conservatives in the back twice by voting to uphold Obamacare on dubious grounds.
Now Roberts’ role as the presiding Judge in a Senate impeachment trial is coming under scrutiny.
In his yearly report on the state of the federal judiciary, Roberts took aim at the President.
Roberts wrote that the judges’ job is to handle each matter before them without “fear or favor” for political interests.
“We should reflect on our duty to judge without fear or favor, deciding each matter with humility, integrity and dispatch,” the Chief Justice claimed. “As the new year begins, and we turn to the tasks before us, we should each resolve to do our best to maintain the public’s trust that we are faithfully discharging our solemn obligation to equal justice under law.”
Roberts also took aim at the President by claiming that the spread of fake news threatened democracy.
“Those principles leave no place for mob violence,” Roberts added. “But in the ensuing years, we have come to take democracy for granted, and civic education has fallen by the wayside. In our age, when social media can instantly spread rumor and false information on a grand scale, the public’s need to understand our government, and the protections it provides, is ever more vital. The judiciary has an important role to play in civic education.”
The Chief Justice made it clear he believes in the baseless conspiracy theory that Donald Trump “invented” the fact that Ukrainians meddled in the 2016 Presidential Election.
Roberts’ statement also calls into question the Chief Justice’s ability to act as an unbiased judge in any Senate impeachment trial.
The good news for the President is if Roberts is a crooked judge that tries to rig the trial against the President, Senate Republicans can check a rogue and lawless Chief Justice.
A Senate impeachment trial is not a legal proceeding.
The rules are whatever 51 Senators vote the procedures are for a Senate trial.
Since Republicans control the Senate, 51 Republicans can overrule any biased rulings by the Chief Justice.
In any case, Republican unity is key to Donald Trump beating back these baseless articles of impeachment the Democrats passed through the House.
Right now there is no indication any Senate Republican actually plans on breaking ranks and joining the Democrats in trying to remove the President from office.
Some Republicans have spoken out about their “discomfort” with Mitch McConnell coordinating impeachment trial strategy with the White House.
But none has yet to go any further and state their intention to stab the President in the back.
