Justice Anthony Kennedy shocked Americans with his decision to announce his retirement from the Supreme Court.
This sets up a battle that will shape American life for the next 50 years.
And Donald Trump just tipped his hand with who he may select to fill Kennedy’s seat.
When Donald Trump was campaigning for President, he pledged to appoint only conservative justices to the bench.
Trump’s promise to fill Antonin Scalia’s seat with a pro-life conservative helped drive Evangelical turnout in record numbers in the 2016 election.
Once in office, Trump made good on his word.
The President not only put Neil Gorsuch on the Supreme Court, but he has filled lower court vacancies with young conservatives at a record rate.
So when Kennedy announced he was retiring after meeting Trump at the White House, conservatives realized they had the chance to pull America back from the left-wing social engineering liberal judges imposed on America.
President Trump briefly spoke with reporters after Kennedy’s announcement and sent Democrats in a spasm of panic when he revealed the selection to replace Kennedy would come from the list of 25 judges the administration released last November.
Trump stated,
“Hopefully we will pick someone who is just as outstanding,” and referred to the possible choices as an, “excellent list of great talent.”
Democrats immediately realized their most cherished Supreme Court victories were in danger of being tossed in the ash heap of history.
CNN’s left-wing legal analyst Jeffrey Toobin sounded the alarm on the air.
Toobin stated that Kennedy’s retirement meant Roe v. Wade would be overturned.
The CNN analyst ranted:
“Let’s talk about facts. Let’s talk about what America is like that is going to be different. You’re going to see 20 states pass laws banning abortion outright. Because they know there are going to be five votes on the Supreme Court to overturn Roe v. Wade.”
Toobin continued,
“Abortion will be illegal in a significant part of the United States in 18 months. There is just no doubt about that.”
The liberal CNN analyst concluded his tirade by stating: “Roe v. Wade is doomed. It is gone because Donald Trump won the election and because he’s going to have the chance to appoint two Supreme Court Justices.”
Liberal activists in the media previewed another line of attack.
Meet the Press host Chuck Todd claimed Republicans holding a vote to confirm Trump’s nominee this fall would violate the precedent Mitch McConnell set in 2016 when he blocked any vote on Obama’s selection of Merrick Garland to fill the seat left vacant by Antonin Scalia’s death.
The absurdity of that statement was obvious to everyone.
McConnell blocked a lame duck President from filling a seat in an election year saying the American people had the right to decide who they wanted making Supreme Court nominations.
2018 is a midterm election year.
The American people already judged that Donald Trump was the man they wanted making Supreme Court nominations by virtue of his victory in the Presidential election.
In addition, there was no major fight over Barack Obama nominating Elena Kagan to the Supreme Court during the midterm election year of 2010.
Kagan was confirmed in August of that year – a similar time frame for the confirmation of President Trump’s nominee, which Senate Majority Leader Mitch McConnell laid out.
This is poised to be President Trump’s most consequential decision.
The President can make good on his word and nominate a Justice who will end the horror of abortion and restore America to its Constitutional roots.
