Georgia was one of the closest states in the 2020 election.
Joe Biden won the Peach State by just 13,000 votes.
Trump claimed fraud in Fulton County – home to Atlanta – swung the state to Biden.
Media outlets investigated the vote counting in Fulton County and found some legal practices that raised questions.
Five thousand of the 148,000 absentee ballots cast in Fulton County were classified as “overvotes” – meaning the voter checked the box for multiple candidates in the same race.
In an investigation of absentee ballots cast in Fulton County, Just the News found the practice of voter adjudication determined which candidate to count the vote for.

The image of the ballot, obtained by Just the News, shows the voter messily scribbled a large blob in the box to select Trump as president while also putting a thinner check mark next to Biden’s name.
At 6:10 p.m. ET on Nov. 4, 24 hours after the ballot was first scanned and rejected by Machine 5150, a panel of humans decided the vote should be awarded to Biden, with the notation “mark removed for Donald J. Trump.” You can see that ballot here:
Scores of additional ballots that same day had checks manually removed next to Trump’s name as well as many other candidates up and down the ticket — Libertarians, Democrats and write-ins alike — and the votes awarded instead to other candidates.
In Georgia, the law states that if a voter mistakenly votes for more than one candidate in the same race they are to write “spoiled” on the ballot and the state will send them a new one.
But Georgia law also allows election officials to determine the intent of the voter.
The law states that if a voter”has marked his or her ballot in such a manner that he or she has indicated clearly and without question the candidate for whom he or she desires to cast his or her vote,” the ballot “shall be counted and such candidate shall receive his or her vote.”
Joe Biden won Georgia by 13,000 votes.
Voter adjudication is lawful and the number of votes where election officials determined which candidate a voter intended to cast their ballot for would not have changed the outcome in Georgia.
But this episode does shine a light on election law in states around the country and the need to clarify vote counting procedures so Americans have faith in the outcome of the election.
