The conservative majority on the Supreme Court failed Donald Trump.
This was a defeat no one saw coming.
And the Supreme Court hit Donald Trump with this tragic news about the 2024 election.
The Real Clear Politics polling average shows Donald Trump leading Joe Biden by 1.3 points.
This is a stronger polling position than Trump ever enjoyed in 2016 or 2020.
But even if Trump wins the presidential election, it won’t matter as much if Democrats control the House of Representatives.
And a Supreme Court decision striking down the congressional maps in Alabama handed the Democrats an upper hand in the battle for the majority in the House of Representatives.
This past June, Republican Justices Brett Kavanaugh and John Roberts joined with the Supreme Court’s three liberals to strike down the congressional maps drawn by Alabama’s Republican legislature.
The Court ruled the map – which featured six Republican-leading districts and one majority-black Democrat district – violated Section 2 of the Voting Rights Act.
Section 2 bans voting practices that discriminate based on race, color or membership in one of the language minority groups.
The Supreme Court held that Alabama’s black population of 27 percent was large enough that the state should have two majority-minority districts.
This ruling essentially handed Democrats another seat.
Alabama Republicans drew a new map that again only had one majority-minority district.
And once again the Court struck the map down.
“Alabama’s open defiance of the Voting Rights Act stops today,” said Abha Khanna, an attorney at the left-wing Elias Law Group that sued Alabama.
“It is now clear that none of the maps proposed by Republican supermajorities had any chance of success. Treating voters as individuals would not do. Instead, our elected representatives and our voters must apparently be reduced to skin color alone,” Alabama Attorney General Steve Marshall stated.
Democrats are now expected to challenge the map in Florida and other red-leaning states to use this ruling to force new maps that hand them new seats.
That could prove pivotal in 2024.
Democrats need to flip just five seats to win back the majority in the House of Representatives.
In this environment even one seat can make the difference over which party will control the House.
Should Trump win the presidency and Democrats hold a congressional majority they will make Trump’s second term a living hell.
A Speaker Hakeem Jeffries would impeach Trump on day one and it would only go downhill from there.
But the real nightmare would be if Joe Biden wins and Democrats hold the majority in the House and Senate.
Democrats would nuke the legislative filibuster allowing them to pack the Supreme Court, add Washington, D.C. and Puerto Rico as states, and pass amnesty and voting rights for 30 million illegal aliens.
