Donald Trump’s enjoying a durable lead in the polls over Joe Biden.
But it all could come crashing down.
And Donald Trump just received tragic news that could end his campaign.
A majority-Democrat court sided with Joe Biden prosecutor Jack Smith in the push to allow Democrats to convict Trump on politically motivated charges ahead of Election Day.
The judges claimed a “vital public interest” outweighed any consideration for the office of the presidency and what it meant to allow a sitting president to prosecute his predecessor.
“We have balanced former President Trump’s asserted interests in executive immunity against the vital public interests that favor allowing this prosecution to proceed,” the opinion read.
“We conclude that the interest in criminal accountability, held by both the public and the Executive Branch, outweighs the potential risks of chilling Presidential action and permitting vexatious litigation,” the opinion continued.
This decision will allow Smith’s case against Trump for contesting the 2020 election to proceed.
In trying to race this trial to completion before Election Day, Jack Smith also argued there was a vital public interest in a speedy trial.
But the Constitution grants the right of a speedy trial to the defendant and it’s theirs to waive.
The judges in D.C. and Smith both had Joe Biden and the Democrat Party’s interest in mind when they spoke of a “vital public interest.”
NBC News’s brand-new poll found Trump leading Biden 47 to 42.
But in the event a jury found Trump guilty the election swung in Joe Biden’s favor 45 to 43 percent.
The only interest in a speedy trial belonged to Democrats hoping to defeat Trump.
Weaponizing the justice system to interfere in the election is Joe Biden’s “plan A” for victory.
The NBC poll showed Trump leading Biden by 35 points on the border and 20 points on the economy, so Democrats don’t have a “plan B.”
Given that an Obama judge who can’t contain her hatred for Trump is overseeing the case and the jury will be all Democrats, Trump stands no chance as the outcome of this trial is already baked in the cake.
A criminal conviction against Trump by an all-Democrat jury in one of these political show trials is the only card left in the deck for Democrats to play.
Trump campaign spokesman Steven Cheung blasted the decision as an attack on the presidency and warned it would open the floodgates of criminal prosecutions against former presidents once the other party won control of the White House.
“If immunity is not granted to a President, every future President who leaves office will be immediately indicted by the opposing party,” Cheung exclaimed. “Without complete immunity, a President of the United States would not be able to properly function!”
“Deranged Jack Smith’s prosecution of President Trump for his Presidential, official acts is unconstitutional under the doctrine of Presidential Immunity and the Separation of Powers. Prosecuting a President for official acts violates the Constitution and threatens the bedrock of our Republic. President Trump respectfully disagrees with the DC Circuit’s decision and will appeal it in order to safeguard the Presidency and the Constitution,” Cheung continued.
Trump will now appeal the case to the Supreme Court.
And Trump will have to hope the Supreme Court will agree to hear this case – the issue of presidential immunity is a novel question the Court hasn’t yet resolved – which will push the trial date past the election.
