Joe Biden and the Democrats suffered defeat after defeat at the Supreme Court.
Biden’s own allies did him no favors.
And now Nancy Pelosi made one confession that doomed Joe Biden in court.
Last year Joe Biden engaged in the most blatant and most expensive vote-buying operation in history.
In order to juice turnout among young voters in the midterm elections Biden attempted to steal over $400 billion from the Treasury to bail out $10,000 in student loan debt for individuals making up to $125,000 a year and $20,000 for couples earning up to $250,000.
Under the Biden plan middle-class Americans and those who played by the rules and paid off their loans would now assume the debt for Harvard-trained doctors and lawyers raking in six figures.
Chief Justice John Roberts wrote for a six-justice majority that struck down Biden’s power grab and rejected the administration’s rationale of using the 2003 HEROES Act to bail out student loan borrowers.
Congress passed the HEROES Act to allow the secretary of Education to waive student loan payments for military members deployed in the war on terror or national emergencies which resulted from a terrorist attack.
Biden illegally claimed the act granted him the authority to transfer student loan debt from borrowers to taxpayers claiming the COVID-19 pandemic was a national emergency.
Chief Justice Roberts and the majority ruled that Biden could not rewrite the law to suit his political needs.
“We hold today that the act allows the secretary to ‘waive or modify’ existing statutory or regulatory provisions applicable to financial assistance programs under the Education Act, not to rewrite that statute from the ground up,” Roberts stated.
The majority also cited the “major questions doctrine” which holds that issues of “vast economic or political significance” require an act of Congress specifically authorizing agency action.
“Today, we have concluded that an instrumentality created by Missouri, governed by Missouri, and answerable to Missouri is indeed part of Missouri; that the words ‘waive or modify’ do not mean ‘completely rewrite’; and that our precedent — old and new—requires that Congress speak clearly before a Department Secretary can unilaterally alter large sections of the American economy,” Roberts added.
And just to spike the football Roberts cited 2021 comments from then-Speaker of the House Nancy Pelosi who slammed the idea of Biden using executive action to bail out student loan debt by stating the obvious that such a move was blatantly illegal.
“People think that the President of the United States has the power for debt forgiveness. He does not. He can postpone. He can delay. But he does not have that power. That has to be an act of Congress,” Pelosi declared.
