This was bad news for Joe Biden.
Democrats’ hope that the weaponized justice system could deliver victory in November 2024 suffered a major setback.
And that’s because the Supreme Court smacked Jack Smith with this brutal defeat.
The Supreme Court rejected Jack Smith’s bid to keep the racehorse pace of the trial against Trump for contesting the 2020 election on schedule.
Trial Judge Tanya Chutkan – an Obama appointee who hates Donald Trump – played her part in the Biden Justice Department’s scheme to jail Joe Biden’s GOP opponent before the November election by scheduling a trial date of March 4, 2024.
Donald Trump filed a motion to dismiss the charges on the grounds of presidential immunity.
Predictably the anti-Trump Chutkan rejected that bid.
Trump then took the natural step of appealing to the D.C. Circuit Court of Appeals where a three-judge panel – two of whom are Democrat appointees – will hear arguments.
If Trump loses at that stage, he will then appeal to have the entire D.C. Circuit Court of Appeals hear the motion en banc.
Finally, should Trump lose there he will then take his case to the Supreme Court.
While all of this is going on, the 2020 election case is on hold.
Smith threw one Hail Mary to have the Supreme Court jump to the head of the line and hear Trump’s immunity appeal immediately.
In a petition to the Supreme Court that Smith conceded was “extraordinary” Smith argued a speedy trial was in the vital interest.
Smith couldn’t say why a speedy trial was in the vital interest or whose vital interest it was in because that would give the game away.
Trump’s lawyers happily filled in the gap pointing out that Smith was a partisan hitman working for Joe Biden and that the only interest advanced by the Supreme Court issuing a ruling at this time on Trump’s appeal to dismiss were Joe Biden’s political interests.
In their filing, Trump’s lawyers wrote that Smith “confuses the ‘public interest’ with the manifest partisan interest in ensuring that President Trump will be subjected to a months-long criminal trial at the height of a presidential campaign where he is the leading candidate and the only serious opponent of the current Administration,” Trump lawyer D. John Sauer wrote.
“The combination of an almost three-year wait to bring this case and the Special Counsel’s current demand for extraordinary expedition, supported by the vaguest of justifications, creates a compelling inference of partisan motivation,” Trump’s lawyers also argued.
Common sense prevailed as the Supreme Court rejected Smith’s banana-republic tactics in a unanimous ruling.
It takes a lot to get the six conservatives and three liberal justices on the same page.
But in this case every justice agreed to smack down Smith’s attempt to strong-arm the Supreme Court into serving as an appendage of the Biden re-election campaign.
