Joe Biden prosecutor Jack Smith filed a motion for the judge in the case – Obama donor and appointee Tanya Chutkan – to slap Donald Trump with a gag order that would prevent him from not just discussing the case in public, but also banning Trump, his attorneys, and campaign surrogates from criticizing Joe Biden, the Justice Department and Attorney General Merrick Garland.
This gag order could result in Donald Trump ending up in jail if Judge Chutkan rules Trump violated the order.
Trump’s lawyers filed a response motion blasting the order as yet another attempt by the Joe Biden Justice Department to bail out the Biden re-election campaign by silencing Joe Biden’s likely 2024 opponent.
“Now, keenly aware that it is losing that race for 2024, the prosecution seeks to unconstitutionally silence President Trump’s (but not President Biden’s) political speech,” the motion added.
A new ABC/Washington Post poll showed Trump leading Joe Biden 52 to 42 and this gag order would allow Democrats to campaign on the fact that Donald Trump is under criminal indictment while preventing Trump or any Republican from fighting back.
The weaponized justice system is set to be a pivotal issue in the 2024 campaign.
A gag order would take a contentious issue that is clearly hurting Joe Biden in the polls – Donald Trump gained support in public opinion surveys following the indictments – and allow the Biden campaign to frame the election as a referendum on Trump.
Trump’s lawyers made this argument in their brief.
“At bottom, the Proposed Gag Order is nothing more than an obvious attempt by the Biden Administration to unlawfully silence its most prominent political opponent, who has now taken a commanding lead in the polls,” the filing added.
“[The] plan is quite simple: unleash a 45-page speaking indictment, leak its talking points in the press, and then cynically attempt…to prevent President Trump [his lawyers and surrogates] from presenting his side of the story to the American people during a political campaign,” the filing continued.
Trump’s lawyers slammed the political meddling in the election by the Justice Department as an abuse of power by using the courts to regulate the political speech of Joe Biden’s Republican challenger.
“The prosecution would silence President Trump, amid a political campaign where his right to criticize the government is at its zenith, all to avoid a public rebuke of this prosecution,” Trump’s lawyers argued.
“The prosecution may not like President’s Trump’s entirely valid criticisms, but neither it nor this Court are the filter for what the public may hear. If the prosecution wishes to avoid criticism for abusing its power, the solution is simple: stop abusing its power,” Trump’s lawyers concluded.
